OVERVIEW

Welcome to Custy!

The terms “Custy”, “we”, “us” and “our” refer to Custy, operated by:

Custy provides a Shopify application, website, and related services that enable merchants to offer real-time product customization and print-on-demand workflows (the “Services”).

By installing, accessing, or using Custy, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree, you must not use the Services.

SECTION 1 – ELIGIBILITY & ACCOUNT

You must be at least the age of majority in your jurisdiction.

You agree that:

  • All information you provide is accurate and complete
  • You are responsible for your account credentials
  • You are responsible for all activity under your account

You may not transfer or resell your account.

SECTION 2 – APP USAGE & ACCEPTABLE USE

You agree to use Custy only for lawful purposes.

You may NOT:

  • Use the app for illegal, fraudulent, or abusive purposes
  • Upload unlawful, copyrighted, or offensive content without rights
  • Distribute malware, spam, or harmful code
  • Attempt to reverse engineer or exploit the app
  • Use automation or scraping tools without permission

We reserve the right to restrict or terminate access if misuse is detected.

SECTION 3 – CUSTY APP FUNCTIONALITY

Custy allows merchants to:

  • Offer product customization to customers
  • Generate previews and print-ready files
  • Process customization data with Shopify orders

Important:

  • Custy does NOT guarantee print accuracy across all devices or printers
  • Visual previews are approximate representations only

SECTION 4 – SHOPIFY BILLING & PAYMENTS

Custy uses the Shopify Billing API.

By using paid plans, you agree that:

  • Charges are processed via Shopify
  • Billing cycles are recurring (monthly or yearly)
  • Charges are billed to your Shopify account

Failure to pay may result in:

  • Suspension of access
  • Downgrade or termination of services

SECTION 5 – REFUNDS & CANCELLATION

  • Custy offers a 21-day free trial
  • After the trial, all charges are non-refundable unless required by law
  • You may cancel anytime via Shopify admin
  • Cancellation stops future billing but does not refund past payments

SECTION 6 – SERVICE AVAILABILITY & LIMITATIONS

We aim to provide reliable service but do NOT guarantee:

  • 100% uptime
  • Error-free operation
  • Compatibility with all themes or apps

Service may be affected by:

  • Shopify platform limitations
  • Third-party services
  • Network or infrastructure issues

We may update, modify, or discontinue features at any time.

SECTION 7 – INTELLECTUAL PROPERTY

A. Custy Ownership

All app technology, design, and branding are owned by Custy and protected by law.

B. User-Generated Content

You retain ownership of:

  • Uploaded designs
  • Images, text, and artwork

However, by using Custy, you grant us a limited license to:

  • Process and store designs
  • Generate previews and print files
  • Deliver app functionality

You confirm that:

  • You have rights to all uploaded content
  • Your content does not infringe third-party rights

SECTION 8 – THIRD-PARTY SERVICES

Custy may rely on:

  • Shopify
  • Google Cloud or hosting providers
  • Payment processors (e.g., Stripe)

We are not responsible for third-party services.

SECTION 9 – ACCOUNT SUSPENSION & TERMINATION

We may suspend or terminate your account if:

  • You violate these Terms
  • You misuse the platform
  • Payment fails
  • Required by law

You may terminate by uninstalling the app.

Certain provisions will survive termination.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Custy operates independently from Shopify.

You agree that:

  • Shopify is not responsible for Custy services
  • Shopify has no liability related to your use of Custy

SECTION 11 – DISCLAIMER OF WARRANTIES

The Services are provided “AS IS” and “AS AVAILABLE”.

We do NOT guarantee:

  • Continuous availability
  • Accuracy of previews or outputs
  • Error-free performance

Use is at your own risk.

SECTION 12 – LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Custy shall NOT be liable for:

  • Lost profits
  • Lost data
  • Business interruption
  • Indirect or consequential damages

Total liability shall not exceed the amount paid for the Service.

SECTION 13 – INDEMNIFICATION

You agree to indemnify and hold harmless Custy from any claims arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your uploaded content

SECTION 14 – PRIVACY

Your use of Custy is also governed by our Privacy Policy.

SECTION 15 – GOVERNING LAW

These Terms are governed by the laws of:

Quebec, Canada

You agree to jurisdiction in Quebec courts.

SECTION 16 – CHANGES TO TERMS

We may update these Terms at any time.

Continued use of the Services means you accept the updated Terms.
